Roger Burchard entered an Alford[Footnote 1] plea to two counts of securities fraud. The plea was the result of an agreement reached with the prosecutors office that the state would dismiss counts II, III, and IV in exchange for a guilty plea on counts I and v. Through his conditional plea of guilty, pursuant to I.C.R. 11(a)(2), Burchard specifically reserved the right to appeal the district courts denial of his motion to dismiss. He timely appealed from the judgment of conviction in this case. We affirm.
